Kern County Marijuana Possession, Case Dismissed

Called in at the last minute, The Kavinoky Law Firm attorney Ben Mironer still managed to successfully defend a marijuana possession charge against each of two of our clients in downtown Shafter (about a half-hour north of Bakersfield). Ben won. Result? Both cases DISMISSED.

Fremont, Alameda County DUI Pled down to Infraction

The client was charged with a DUI and the District Attorney was not making any offers of a reduced charge. The Kavinoky Law Firm attorney Amy Hoffman was prepared to take the case all the way to a jury trial-- and the DA then agreed to reduce the charge to an infraction.

Alameda County 1st Offense DUI, No DMV License Suspension

Congratulations to Amy Hoffman for earning a DMV "set aside" (meaning the client got to keep their driving privileges).

Amy was able to make a case of the faulty timeline the arresting officer had written down to win the hearing.

This was purely and simply a case where the officer claimed to have arrested our client on March 11, 2010 but wrote down that our client was driving on March
12, 2010. We raised the simple point that our client could not have been driving after he was already arrested.

Modesto, Stanislaus County 2nd Offense DUI, No DMV License Suspension

Amy was able to exploit the holes in law enforcement’s case: the officer swore

Siskiyou County 1st Offense DUI, Not Guilty

The Kavinoky Law Firm attorney Ben Mironer, earned a DMV "set aside" for our client. The Kavinoky Law Firm DMV Team turned in an exceptional "Request for Administrative Review." The request was powerful enough that the DMV did not even hold the hearing and instead just issued an outright set aside.

We have just received notice of a SET ASIDE for our client. Steven O'Connor would not let up in this case from a Pitchess MX to in-person hearings to “Killer Cross” of the Officer, it all worked. This was huge for this client as he is a retired Sheriffs Deputy and the Officer involved in this case had a previous professional ax to grind with our client.

Los Angeles County DUI Sobriety Checkpoint Case, Case Dismissed

Steven O’Connor won a 1538.5 motion today in the XXXX case. This is a sobriety checkpoint case involving a client which was referred to us by a previous client. Steven was able to convince the Judge that the checkpoint did not meet the criteria established in Ingersoll and other case law. The particular issue that did not meet the criteria was the lack of an escape route. The Judge sided with Steven and The Kavinoky Law Firm wins for our client.

San Bernardino County DUI, NO DMV License Suspension

We received notice today of a SET ASIDE in our client's matter.
Pamela Lacey argued that the first prong of time of driving was not satisfied.
Additionally, the blood draw did not meet the Glatman qualification of
having been analyzed “at or near the time of the event.”

Los Angeles County 1st Offense DUI, Not Guilty

Client was found not guilty by a jury. Attorney Steven O'Connor proved that there was reasonable doubt on the charges brought up against the client. The 12 jurors found Steven's argument valid, deliberated and returned a not guilty verdict.

Los Angeles County DUI with a BAC of .08, DMV License Suspension

Congratulations to the Team of Joel Koury and the DMV team

Joel and the DMV team worked together to motivate the DMV
not to go forward against our client.

This was a borderline .08 case.

Santa Barbara County 2nd Offense DUI, Case Dismissed

Good afternoon sir. My name is XXXX and I hired your firm to represent me on a DUI charge in Santa Barbara that occurred on September 18th, 2009. This was a very serious matter for me as it would've been my 2nd DUI charge as my previous one occurred in Michigan in 2008.
